As always, a great article. I attended a court conference this morning. This particular judge does all his conferences on the record, so a court reporter was making a transcript of everything stated in the courtroom. One of the attorneys on the case before mine held up his client’s phone. He then read a text message from the opposing party to his client. I can’t repeat the language he read. Needless to say, it was NOT pretty, and now it’s available to anyone who reads the record. Ouch!
On the other hand, if you are divorcing a high conflict individual who routinely lies about what was said and by whom, texting is the only way to have any meaningful interaction.
