When we talk about equitable distribution, it really has to do with marital/joint property. But in mediation, we have to make a distinction between what is actually joint property and what is separate property. Most people know that retirement or pension monies accrued before marriage are separate, but inheritances and personal injury rewards are separate as well. Parties don’t realize they have legal protections as a married spouse.
